Conditions
These Terms & Conditions (“Terms”) govern your use of the Concrete website and any services we provide. By using this site or engaging us, you agree to these Terms. Concrete’s head office is at 101 Pakenham Street West, Auckland 1010, New Zealand.
Our services
Concrete provides design, branding, web development, paid advertising, 3D/motion and related growth services. The specific scope, deliverables, timeline and price for any engagement are set out in a written proposal or quote agreed between us. Where a signed proposal conflicts with these Terms, the proposal prevails for that engagement.
Quotes and proposals
Quotes are valid for 30 days unless stated otherwise and are based on the information available at the time. Work outside the agreed scope may require a revised quote before it proceeds.
Fees and payment
Fees, deposits and payment terms are as stated in your proposal. Unless agreed otherwise, invoices are payable within the timeframe shown on the invoice. We may pause work on overdue accounts. Prices are in New Zealand dollars and exclusive of GST unless stated.
Client responsibilities
- Provide accurate briefs, content, brand assets and feedback in a timely manner.
- Ensure you own or are licensed to use any materials you supply to us.
- Review and approve deliverables at the agreed checkpoints; delays in approvals may affect timelines.
Intellectual property
Ownership of final deliverables transfers to you once the relevant invoices are paid in full. Until then, all work remains our property. We retain ownership of our pre-existing tools, know-how and working files, and the right to display completed work in our portfolio and marketing unless you ask us in writing not to.
Third-party services
Projects may rely on third-party platforms, plugins, fonts or services, each subject to their own terms and fees. We are not responsible for third-party outages, changes or costs, and any such fees are your responsibility unless included in your proposal.
Warranties and disclaimers
We perform our services with reasonable care and skill. Except as required by law (including the Consumer Guarantees Act 1993 where it applies), our services and this website are provided “as is” without further warranties. We do not guarantee specific commercial outcomes, rankings or results.
Limitation of liability
To the maximum extent permitted by law, our total liability arising from any engagement is limited to the fees paid to us for that engagement, and we are not liable for indirect or consequential loss, loss of profit or loss of data.
Confidentiality
Each party will keep the other’s non-public information confidential and use it only for the purpose of the engagement.
Termination
Either party may end an engagement in writing. On termination, you agree to pay for all work completed and costs committed up to that date.
Governing law
These Terms are governed by the laws of New Zealand, and the New Zealand courts have exclusive jurisdiction over any dispute.
